taken. i think that hain of us might agree that we want to see more people bicycle ling whether to mute commuting to work or family outings as well and i have i should mention that i have had two bicycles stolen from my garage in my building over the past couple of years and also in inner richmond as well and we want to look at city wide data on the issues and bike thefts are on the rise at about 3,000 per year in san francisco and $3 million worth of bicycles are pistollen each rather year and we might see that income as people choose bicycling as a more viable means of transportation given the oil crisis. and i also want for stronger bicycling and other mobile means of transportation, we may see that thefting become on the rise and one of the greatest -- are according to the san francisco bicycle coalition. i i wanted to whether as add that there have been some -- including san franciscotion police department apprehension of a thief that took one 14 bicycles last july and a successful sting and the bicycle coalition have held numerous workshops to educate riders on how to prevent bik
will need to look at that increase in projected revenue to help us get to the needed levels. the increases that we are looking at are largely associated with the labor and negotiations that took place last year and the contracts that are in place for the next couple of years. so those are going to increase our salary and fringe benefit cost to a certain degree and we know last year at this time we discussed reducing the city order and we brought it down to $180,000 to $130,000 and we talked about reducing it further going forward to $120,000. at this point i am not going to recommend that we any lower than we are now. we had a work order with the city attorney for the last five years and the utilization has fluctuated over the last five years and that has depended on a lot of factors and it has to do with the caseload and the volume of the cases and the length of board meetings and the hours that the city attorney has to sit with us and the complexity and uniqueness of the cases and the number of new board members that come on and increase of on boarding those members and also changes in t

on the non-conforming use controls. thank you. >> thank you. >> good afternoon, supervisors. my name is janet clyde and my name was called in error in the previous item or you would have had my speaker card. i am a former small business commissioner and i'm here to speak on a couple of things that i heard this afternoon. the first is that i would like to congratulate the work of the western soma task force and i hear that arts are principally permitted throughout the district. i would like to have you consider the llp as a low-impact usage. i was one of the first proponents of this new permit and it was not in existence during much of the creation of the western soma plan. so i think performing arts and this limited accessory use is important, because in order for very small businesses to succeed, we need to give them the tools to succeed. so please look at that. the other thing that i heard was this is an historic opportunity to exclude housing in a principally permitted entertainment district. i know this is a very difficult decision, but it's a very important one, because i have

a different type of use and just out of respect for that conversation i was going to wait off and on that grand fathering issue. we have a second grand fathering issue on the academy of arts, which is on townsend street. and this would grandfather in the cu application and not of the use itself. i was going to ask planning some questions about that, but i wanted to go through the outstanding issues first. the second outstanding issue is the reducing the flexibility for historic buildings. this was a recommendation made by planning. i am going honor planning's recommendation regarding this. while there are a number of buildings historic on their on, if you look at the number contributing, it's an incredible number within the west soma plan and i don't think that was the intention of the plan to allow such greater flexibility for such a great proportion of buildings. so i will support planning's recommendation. what chair wiener brought up is increased inclusionary housing fees. those are that are half an acre or more. again this is consistent with eastern neighborhoods. the p
the institutions that have served us so well over the last half century. they are dramatically changing. you see it certainly in media. you've seen it in the financial service industry now increasingly serving the music industry. and you see it in city government. you are a big participant in that dramatic evolution or what i would argue, the dramatic punctuation point in terms of the world we live in. i don't think it's cyclical. i think something dramatic is taking shape here as it relates to particularly the impact of technology is having on the world we're living in. we're living in a fish bowl. the whole idea of holding back information and keeping that information for those [speaker not understood] those in power, those days are over. age of amateurs, big is getting small, small is getting big. this democracy of voices, new contours of a new society, truly i think is being shaped. and, so, you are a big part of that. and i hope the spirit of engagement, civil grand jurors across the state, is respected in that light. as a supervisor, i was a big champion of you. as a marry was a little mor
is there is a demand by many businesses for the broader floor plates and it allows tech uses and other uses that need this kind of configuration to come to satisfy. and i know of another situation that's similar to this at the present time uop [speaker not understood] dental school is renovating a building that already has these broad plates on 5th street near mission. and i was a graduate of the earlier facility and i can speak to the difficulty that facility has in its present location because of the narrowness. so, it's not just tech, but other uses. it's important that we get broad floor plates. however, this has to be correct and i think the things they've done in terms of tower separation, bulk, are very much in keeping with the code. as was pointed out by mr. guy, because of the tdr sold by 6 20, 63 1 howard, there never will be another tower that they have to separate themselves from because even if that building were to be destroyed in a fire or some other manner, it could never be built to more of a height than it's at now because they've already sold their tdrs. and then the bulk, there ar

that the limited use of the off-site food prep for cafe floor be expanded and more broadly applied. the proposed ordinance would create a path to legalize what appears to be an illegal accessory kitchen located at 260-1/2 noe street, which supports the very small kitchen at cafe floor. and as proposed, this provision would sunset after one year. and during that one year the operator could obtain all necessary permits, go through 312 notification, and then that use when the provision -- when the ordinance sunsets would become a legal nonconforming use. the department recommends that the commission recommend a modification that it would expand the provision in very specific ways and that would, first, it would remove the sunset provision. secondly, it would require that food processing as an accessory use either be very active and visible to the street front consistent with planning code section 145. or that it be completely screened from view behind an active use so that the active street frontage is maintained. next, we also recommend that the ordinance explicitly prohibit serving the public in

. >> this resolution is approved. now we have car share use and making the requisite finding >> i thank you mr. president. before us today is legislation that will encourage more car sharing availability throughout the city. this will correct planning code processions that are currently indulge dedicated car sharing spots. the failure undermines car sharing in san francisco and this legislation does recommend that. the legislation has the unanimous support of the mta and that agency requested certainly plans and i did take care of that. we've never be transit without car sharing. from time to time they will need access to a car. for each car spots unfortunately, many of the location where we currently have car sharing pods are sdoip. many gas station parking lot are being developed. we have a slow process in terms of increasing the numbers of car spots. car companies are challenged with finding available spots. the planning codes actually e rekdz obstacles in car sharing. currently car share spots are treated the same as car sharing spots so if the developer wants tocally several car sharing s

[speaker not understood]. since that time he's been able to get multiple changes to the law. mr. weiss said that have increased his possibility, including the allowance of live music and granting of a liquor license for full bar. the staff, and the level of expertise in helping us make decisions and move forward on a number of key projects. i want to say thank you for your great service and wish you all the best. you have many years ahead of you to explore music, and your loved ones and i wish you all the best. >> colleagues, any other comments? one we now go to mr. moscovitch. >> good morning chairman and commissioners. i am honored to have been asked back. i am at the tail end of the flu, my voice is low. i appreciate your comments mr. chairman. i will give you a couple of observations. first of all the city and the challenges it brings is way too complex for a single person to ever be able to make a mark. this is an excellent example where teamwork is needed; there has been amazing teamwork with my former staff, with the city departments, with our partners at the regional, state and federal levels all of whom have contributed tremendously. that may say about those relationships because it's very easy to turn everything into a soundbite. a relationship is something to work on. we are not all around here to

that some of us will be glad that we won't have a regular mcdonald's patron in our midst. [laughter] >> i think that we will miss the fact that -- well, actually i'm not sure we'll all miss the fact that carmen rarely breaks with her modern colleagues, except on the critical issue of cat de-clawing. oh, you remember that. i think many of us will miss the fact that she has been so hard working that we were all surprised that today she didn't submit any new legislative proposals and at the last minute she asked me four tough questions about the ndaa which i appreciated. and i will just say for me, one thing i'm not going to miss as you leave is that no one is going to wonder after today if i have a sister on the board of supervisors. director. i believe that commissioner avalos will be able to handily take the wheel and help us usher and addresses key issues that i've outlined today. thank you. >> thank you commissioner, before i turn to commissioner wiener, i want to ask if there is any other member of the public who like to say something else on this item? public comment on this is closed. commissioner wiener. >>i'm happy to support commissioner avalos as chair. sometimes something to get lost in the debates is that even though we have areas of disagreement but often get a lot of attention, a lot of press coverage because anytime you have a big dispute at city hall that is likely to get the attention, in reality when it comes to transportation policy in the city, the vast majority of what we do and what we need is completely not controversial when working together on getting high speed rail, transit, that we get adequate funding from muni, improving pedestrian safety, bicycle roads, we have broad consensus. i know that our chair campos, we are proof in the pudding, we have had our disagreements. as chair and
special use district that has been in place for a number of years that creates restriction on what kind of business can go in there. anytime you place limitations there are unintended consequences. we are dealing with tweaking that as well, the point is that what works in one neighborhood may not necessarily work in another and whatever you come up with something that should be reflecting have what the neighborhood needs and what the community wants. what i see here is a compromise that strikes i think a good balance among the various interest with something like this i think a good deal of deferens should be given to the supervisor and the community who understand the ground to represent that district w that i -- and by the way, a couple points i know that i would expect walgreen's to continue to work with the community. this is approved to continue with the district of supervisor and it's great to see there will be 30 union jobs created and i'm sure walgreen's will make sure we have a diverse population of the work force and would encourage that and kudos to the community groups and
force. it was an impressive process and actually an example that any community should use when trying to plan their future. there was a lot to be learned from the western soma task force and hue they went about their business. i know supervisor wiener you have concerns and i am concerned that as you press your concerns you will derail the plan and you will further delay it. while it won't be undone, it really is in a way kind of disrespectful to the hundreds of people who put thousands and thousands of personal hours into this plan to try to get something that is as good as can be. and yet, people will never always be satisfied with this. i think it's a good plan. i hope you adopt it. i hope you adopt it as-is. and i think it will do the greatest good for the greatest number of people. and that is sort of my ethical standard, serving the greatest good for the greatest number of people. thank you. >> thank you, mr. lewis. >> ladies and gentlemen, welcome to friday and saturday night. you are seeing a representation of the density in and out of the area within the timeline of the top
on market street and we would use market street to make the top class bicycle facility and in a better way then what we could on market street because we don't have rails we have all perpendicular intersections were we would be able to time the signals like we have on van. so in your protected bike lane i don't have to stop. it would make it easier to move for automobiles off of market street. and we still have one of our busiest bus lines. did you have a question? >> before you move on to your final phase of the presentation. just some questions about the 3 options. do you have a sheet which has a relative costs that you could provide to us for the 3 options? and if i'm reading it correctly in comparing the market street options the shared bike assess and the bicycle tracks which requires the curb changes etc. the bicycle track option is approximately a 10 percent more expensive than the shared bike options. am i reading that correctly? >> yeah, that's correct. >> that's actually very encouraging if one were to take the position to take the bicycle path is a good thing. i know with one
or proposed for the next budget cycle to get us through the next phase on how much more we're going to need. we've identified a couple of options. i want to clarify this isn't money that doesn't exist. some things that agencies would have in their capital budgets the enhancements is the delta we're going to have to figure out to fund. this is something i think would be an appropriate topic for the mayors staff. it's very common more than normal or not we start a project before accident funding is there. if we started the project only when we had enough money we wouldn't start the projects. i th think this would be a terrific project for grants. thanks for the time >> thank you for the presentation. i have a lot of these questions but i'll save them. we have to get ready for our next meeting. so we can go onto public comment. if anyone wants to comment please come forward >> i want to say on the face of it when i heard the the plan to push the bicycle traffic down to mission i was more surprised it seems unnatural. if you look at a map and see what goes on there the city flows like a funn
